Refund Policy of the Website tagz.now

ARTICLE 1. PARTIES

This Refund Policy applies between D.B. FRIPE, a simplified joint-stock company (SAS) with a share capital of €30,000, registered with the Trade and Companies Register of Rouen, France, on 09/08/2024 under number 931 795 991, having its registered office at 159 ROUTE DE PARIS, 76920 AMFREVILLE-LA-MI-VOIE, FR, telephone: +33 (0)6 61 22 49 75, email: contact@tagz.now, VAT number: FR81931795991 (hereinafter the “Seller”), and any natural or legal person purchasing a Product via the website tagz.now (hereinafter the “Customer”).

ARTICLE 2. DEFINITIONS

Customer: any natural or legal person purchasing Products on the Website.

Website Content: all materials published on the Website, whether protected by intellectual property rights or not, including texts, images, designs, presentations, videos, diagrams, databases, and software.

Seller: D.B. FRIPE acting as the operator of the Website.

Visitor: any person accessing the Website.

Product: any goods sold on the Website by the Seller to Customers.

Website: the website accessible at tagz.now and all related sub-sites, mirror sites, portals, and URL variations.

ARTICLE 3. SCOPE

Access to the Website is free of charge. Browsing the Website implies full acceptance of these terms. By placing an order and checking the relevant acceptance box, the Customer acknowledges having read and accepted these terms, which have the same legal value as a handwritten signature.

The Customer confirms having the legal capacity to enter into this agreement or acting with proper authorization.

ARTICLE 4. PURPOSE OF THE WEBSITE

The Website is dedicated to the sale of Products.

Products are sold exclusively in lots composed of second-hand items. The Customer acknowledges being informed of the specific nature of such Products, their random selection, and their potential resale purpose. No guarantee is provided regarding specific brands, models, resale margins, or exact assortment composition beyond the general description provided (category, grade, weight, and type).

ARTICLE 5. ORDER PROCESS

5.1 Placing an Order

Customers may select Products and add them to their cart. Availability is indicated on each product page.

5.2 Order Confirmation by the Customer

Before confirming the order, Customers may review the nature, quantity, and price of the selected Products.

5.3 Payment

Customers will be redirected to a secure payment interface clearly indicating an obligation to pay.

Payment methods include PayPal, Shopify Payments, Apple Pay, and any other locally available payment methods depending on the Customer’s country.

The Seller does not store payment card details. Payments are processed directly by authorized payment providers.

5.4 Order Confirmation by the Seller

Upon receipt of payment, the Seller will send an order confirmation email within 24 hours.

ARTICLE 6. PRICES AND PAYMENT

6.1 Prices

Prices are displayed in euros and include VAT where applicable. Shipping costs, customs duties, import taxes, and local charges may apply depending on the Customer’s location and remain the responsibility of the Customer unless otherwise stated.

6.2 Invoicing

Invoices are issued electronically. The Customer expressly agrees to receive invoices in electronic format.

6.3 Retention of Title

Products remain the property of the Seller until full payment of the purchase price has been received.

ARTICLE 7. CLAIMS – WITHDRAWAL – WARRANTIES

7.1 Customer Service

Customer service is available Monday to Friday, 09:00 to 18:00 (CET), via email at contact@tagz.now. The Seller aims to respond within 24 hours.

7.2 Right of Withdrawal (Consumers Only)

This Article applies exclusively to Customers qualifying as consumers under applicable consumer protection laws. Professional Customers are not entitled to a right of withdrawal.

7.2.1 Conditions

Consumers have a period of fourteen (14) calendar days to withdraw from the contract without providing any reason and without penalty, except for return shipping costs.

The withdrawal period begins from the day the Consumer or a third party designated by them (other than the carrier) takes physical possession of the goods. For multiple deliveries, the period runs from receipt of the last item.

To exercise the right of withdrawal, the Consumer must notify the Seller through an unequivocal statement sent to the contact details provided in Article 1.

How to Request a Return

Customers may submit a return request via their online account by following the return procedure available on the Website.

If the return is approved and shipping is required, the Customer will receive return instructions by email.

7.2.2 Effects of Withdrawal

The Consumer must return the Products without undue delay and no later than fourteen (14) days after communicating the decision to withdraw.

The Seller shall reimburse all payments received, including standard delivery costs, within fourteen (14) days from notification of withdrawal. The Seller may withhold reimbursement until receipt of the returned goods or proof of shipment, whichever occurs first.

Reimbursement will be made using the same payment method as the original transaction unless otherwise agreed.

Return Costs and Liability

Return shipping costs are borne by the Customer.

⚠️ Mandatory shipping method:
Returns must be sent to the following address: TAGZ, 4 Bis Rue Léonard de Vinci, 60230 Chambly, France.

For logistical reasons, we do not accept returns to relay points, lockers, or third-party collection points (Mondial Relay, Relais Colis, Shop2Shop, etc.). Our teams do not collect packages outside of our warehouse. Any package left at a relay point will be considered undelivered, will remain your responsibility, and will not be eligible for a refund. We recommend using a carrier that delivers directly to the address provided with signature confirmation (such as Colissimo, DPD, or UPS).

The Customer remains responsible for the goods until they are received by the Seller. The Consumer is only liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods.

Specific Conditions for Lot Sales

As Products are sold exclusively in complete lots, withdrawal applies only to full lots. Partial returns are not accepted.

The returned lot must be complete and in its original condition. If incomplete or damaged beyond normal inspection, the Seller reserves the right to refuse the return or apply a proportional deduction corresponding to the loss in value.

7.2.3 Exceptions

The right of withdrawal does not apply in cases provided by applicable law, including but not limited to personalized goods, goods unsealed for hygiene reasons, goods inseparably mixed after delivery, and fully performed services where prior express consent was given.

7.3 Contract Termination Due to Delivery Delay

If delivery is delayed beyond seven (7) days from the agreed date, Consumers may request contract termination and reimbursement unless the delay is due to force majeure.

7.4 Legal Warranties

Consumers benefit from statutory legal guarantees applicable in their country of residence, including the legal guarantee of conformity and the legal guarantee against hidden defects where applicable.

Due to the nature of second-hand lot sales, variability in assortment does not constitute a lack of conformity if the delivered lot matches the general description (category, grade, weight, and type).

ARTICLE 8. FINAL PROVISIONS

8.1 Governing Law

These terms are governed by French law. However, consumers residing in another EU Member State benefit from mandatory consumer protection provisions of their country of residence.

8.2 Disputes and Mediation

In case of dispute, Consumers may seek amicable resolution before initiating legal proceedings. Where applicable, Consumers may contact a local consumer protection authority or accredited mediation body in their country of residence.

8.3 Severability

If any provision is deemed invalid, the remaining provisions shall remain in full force and effect.

8.4 Non-Waiver

Failure by the Seller to enforce any provision shall not constitute a waiver of that provision.

8.5 Language

This policy is provided in English for international Customers. In case of discrepancy with other language versions, the French version shall prevail.
