ARTICLE 1. PURPOSE

The purpose of this shipping policy is to define the terms and conditions applicable to the shipment of a Product to the Customer by the Publisher.

ARTICLE 2. PARTIES

This shipping policy is applicable between D.B. FRIPE, SAS, share capital: €30,000.00, registered with the Rouen Trade and Companies Register in France on 09/08/2024, under number 931 795 991, registered office: 159 ROUTE DE PARIS, 76920 AMFREVILLE-LA-MI-VOIE, FR, telephone: +33 (0)6 61 22 49 75, email: contact@tagz.now, intra-community VAT number: FR81931795991, hereinafter "the Publisher" and any person, natural or legal, under private or public law, registered on the Site to purchase a Product, hereinafter "the Customer".

ARTICLE 3. DEFINITIONS

"Customer": any person, natural or legal, under private or public law, registered on the Site.

"Site Content": elements of any nature published on the Site, whether or not protected by intellectual property rights, such as texts, images, designs, presentations, videos, diagrams, structures, databases, or software.

"The Publisher": D.B. FRIPE, SAS, acting in its capacity as publisher of the Site.

"Internet User": any person, natural or legal, under private or public law, connecting to the Site.

" Product”: goods of any kind sold on the Site by the Publisher to Customers.

Site”: website accessible at the URL tagz.now, as well as related subsites, mirror sites, portals, and URL variations.

“Shipping time”: the period required for the publisher to prepare and hand over the Product to the carrier.

“Delivery time”: the period required for the carrier to deliver the Product to the Customer, starting from the moment the carrier takes charge of the shipment.

ARTICLE 4. SCOPE OF APPLICATION

The Site is freely accessible to all Internet users. Browsing the Site implies acceptance by all Internet users of this shipping policy. Simply connecting to the Site, by any means whatsoever, including through a robot or browser, will imply full acceptance of this shipping policy. When registering on the Site, this acceptance will be confirmed by checking the corresponding box.

The Internet user acknowledges having fully understood and accepted them without restriction.

Checking the aforementioned box will be deemed to have the same value as a handwritten signature from the Internet user. The Internet User acknowledges the evidentiary value of the Publisher's automatic recording systems and, unless they provide proof to the contrary, waives the right to contest them in the event of a dispute.

This shipping policy applies to the relationship between the parties to the exclusion of all other conditions, including those of the Internet User.

Acceptance of this shipping policy assumes that Internet Users have the necessary legal capacity to do so, or failing that, that they have the authorization of a guardian or curator if they are incapable, of their legal representative if they are minors, or that they hold a power of attorney if they are acting on behalf of a legal entity.

ARTICLE 5. DELIVERY

5.1. Delivery Costs

Delivery or provision costs will, in all cases, be indicated to the Customer before any payment and only apply to deliveries made in mainland France, including Corsica. For any other delivery location, it is the Customer's responsibility to contact customer service.

In the event that the Product is delivered to the Customer in-store or at a Publisher partner location, the related costs will be specified to the Customer at the time of ordering.

The prices shown include all taxes and may vary depending on the delivery method chosen and the weight or volume of the Product.

5.2. Shipping and Delivery Times

 • Shipping Times: Orders are prepared and shipped within 24 to 72 business hours of payment confirmation.
 • Delivery Times: Delivery time depends on the shipping method chosen by the Customer and their location.
 • Metropolitan France: 1 to 2 business days for home delivery, 3 to 4 business days for delivery to a pickup point.
 • International: 2 to 4 business days, varying depending on the country and quantity ordered.

Legal Note: A delay in the shipping time does not automatically entitle the Customer to compensation if the Customer is informed and the Product is shipped within the stated timeframe (see Consumer Code). Any exceptional delay will be communicated to the Customer as soon as possible. • Warehouse Pickup: Customers located nearby can pick up their order directly on-site only on weekdays, from 9:00 AM to 6:00 PM, by appointment. A tracking number is provided to the Customer upon shipment to allow them to track the package's delivery. 5.3. Damaged Package If a package is delivered that is clearly and visibly damaged, the Customer must refuse it in order to benefit from the carrier's guarantee. The Customer must also inform the seller immediately so that a new package can be prepared and shipped as soon as the damaged package is received. In such a case, the delivery times indicated above in these terms and conditions will no longer apply.

5.4. Retention of Title - Transfer of Risk

Ownership of the delivered Products remains with the Publisher until delivery of the Products to the Customer, notwithstanding any clause to the contrary, unless the parties have specifically and expressly agreed in writing to waive this clause.

In accordance with Article L216-4 of the French Consumer Code, any risk of loss or damage to the Products is transferred to the Customer when the Customer, or a third party designated by the Customer, takes physical possession of the Products.

When the Customer entrusts delivery to a carrier other than the one proposed by the Publisher, the risk is transferred upon delivery of the Product to the chosen carrier.

5.5. Incorrect Address – Unclaimed Package – Return to Sender

The Customer is solely responsible for the accuracy and completeness of the delivery information provided when placing the order.

In the event of an incomplete or incorrect address, failure to claim the package within the carrier's timeframe, repeated absence at the time of delivery, or any other cause attributable to the Customer resulting in the package being returned to the sender, the Customer will be fully responsible for the reshipping costs.

Reshipment will only occur after payment of the new delivery charges.

The initial delivery charges are non-refundable.

5.6. Force Majeure

The Publisher shall not be held liable for any delay or inability to deliver resulting from a case of force majeure as defined in Article 1218 of the Civil Code or from an event beyond its control (strike, exceptional weather conditions, transport disruptions, etc.).

ARTICLE 6. FINAL PROVISIONS

6.1. Applicable Law

This shipping policy is subject to the application of French law.

6.2. Changes to this shipping policy

This shipping policy may be modified at any time by the Publisher. The shipping policy applicable to the Customer is the one in effect on the day of their order or their connection to this Site. Any new connection to the personal space implies acceptance, where applicable, of the new shipping policy.

6.3. Disputes

Pursuant to Ordinance No. 2015-1033 of August 20, 2015, any disputes with a Consumer Customer that may arise in connection with the execution of these general terms and conditions and for which an amicable solution cannot be found beforehand between the parties must be submitted.

Since As of January 1, 2016, mediation is mandatory for everyone. Thus, any professional selling to individuals is required to provide the contact details of a competent mediator in the event of a dispute, regardless of whether they sell remotely or in a physical store (Source: FEVAD).

6.4. Entirety

The invalidity of one of the clauses of this contract will not invalidate the other clauses of the contract or the contract in its entirety, which will retain their full effect and scope. In such a case, the parties shall, to the extent possible, replace the cancelled stipulation with a valid stipulation corresponding to the spirit and purpose of this Agreement.

6.5. Non-waiver

The Publisher's failure to exercise the rights granted to it herein shall in no event be interpreted as a waiver of said rights.

6.6. Telephone Soliciting

The Customer is informed that they have the option to register on the telephone solicitation opt-out list at the following address: http://www.bloctel.gouv.fr/.

6.7. Languages of this Shipping Policy

This shipping policy is available in French.

6.8. Unfair Terms

The provisions of this shipping policy apply subject to compliance with the mandatory provisions of the French Consumer Code regarding unfair terms in contracts concluded between a professional and a consumer.

ARTICLE 7. RETURNS

7.1. Returning Products

Detailed procedures are specified in the Returns section of the Website and may vary depending on the return address.

7.2. Store-Specific Return Policies:

• Return address if different from the store address: TAGZ, 4 bis rue Léonard de Vinci, 60230 Chambly, France.
• Returns must be reported within 14 days of delivery (for individual customers with the right of withdrawal).
• For business customers, the right of withdrawal does not apply, in accordance with the General Terms and Conditions of Sale.
